Who must be licensed
Asbestos abatement activities generally require DEP licensing/certification unless an exemption applies. See Title 38 §1273 and DEP’s asbestos pages. Licensed business lists (contractors, consultants, laboratories, training providers) are linked from the DEP asbestos page.
Notification before work
For asbestos abatement activity over 3 linear feet or 3 square feet of ACM, written notification to the commissioner is required — postmarked at least 10 calendar days before, or delivered at least 5 working days before, on-site work (including preparation). Source: 38 M.R.S. §1273.
Inspections before demo/reno
Owners of buildings other than residential buildings with fewer than 5 units must have a DEP-licensed Asbestos Consultant inspect for asbestos before demolition/renovation that could disturb ACM. Demolition notification to DEP is required at least 5 working days prior for buildings other than single-family residences, even if no asbestos is found. Source: DEP inspection requirements.
Homeowner-related notes
DEP states owner-occupied single-family homeowners can remove their own asbestos siding following DEP guidelines. Single-family residences never used commercially, and certain post-1980 2–4 unit dwellings, are described as exempt from the inspection requirement on DEP’s inspection FAQ — homeowners remain responsible for disturbance of ACM over 3 sq/ft or linear ft.
